If you do not agree to the Terms, do not register for the Service. The Terms are subject to change by Interactive Web Media, LLC. 'The Link Trade Network' at any time, effective upon posting such changes by Interactive Web Media, LLC. 'The Link Trade Network' on the TheLinkTrade.Com website.

The term "Advertiser" refers to you, the user who registered for text link advertisements. "TheLinkTrade.com" refers to the web site TheLinkTrade.com, its service and associated parties, including the owners and operators of said web site, Interactive Web Media, LLC.

The information contained on this Web site is provided in good faith on an 'as is' basis. The information is believed to be accurate and current at the date the information was placed on this Web site. Eligibility

You must be at least eighteen (18) years old to register as an Advertiser of TheLinkTrade.Com . Minors may not become Advertisers. By becoming an Advertiser, you represent and warrant that you are at least eighteen (18) years old.

Right to Refuse

TheLinkTrade.com reserves the right to refuse, without liability, any advertising requests, or to cancel advertisements that do not fulfill the terms of this agreement and/or conform to the technical specifications, with or without notice to the Advertiser. TheLinkTrade.com does not accept advertising requests from organizations promoting products or services related to pharmaceutical products (Viagra and Phentermine), adult content, hate, racism or any offensive or illegal material.

Indemnification from Liability

Advertiser is solely responsible for any legal liability arising out of or relating to the advertisement, and/or any material linked through the advertisement. Advertiser represents and warrants that the use, reproduction, distribution, or transmission of the advertisement will not violate any criminal laws or any rights of any third parties, including, but not limited to, such violations as infringement or misappropriation of any copyright, patent, trademark, trade secret, music, image, or other proprietary or property right, false advertising, unfair competition, defamation, invasion of privacy or rights of celebrity, violation of any anti-discrimination law or regulation, or any other right of any person or entity. Advertiser agrees to indemnify TheLinkTrade.com and to hold TheLinkTrade.com harmless from any and all liability, loss, damages, claims, or causes of action, including reasonable legal fees and expenses that may be incurred by TheLinkTrade.com, arising out of or related to Advertiser's breach of any of the foregoing representations and warranties.

Limitation on Damages / Liability

In no event will TheLinkTrade.com be liable to the Advertiser for any direct, indirect, special, incidental, consequential or punitive damages for use of TheLinkTrade.com or any other hyper-linked Web sites including, but not limited to, lost profits or revenues, costs of replacement, business interruptions, loss of data or damages resulting from use of or reliance on the information present, whether based on breach of contract, tort, negligence, or otherwise, and whether or not TheLinkTrade.com has been advised of the possibility of such damage. TheLinkTrade.com will not accept any responsibility arising in any way (including negligence) for errors in, or omissions from, the information contained on this Web site. We make no warranty that the Web site or any products or services advertised on the Web site will meet your requirements, or that the Web site will be uninterrupted, timely, secure or error free.

Payment and Refund Policy

Advertiser agrees to pay in full according to the provisions of this agreement.

Any amount paid is not refundable except in the event that we do not advertise your ad or reject your text link ad for any reason. Payments for approved ads are strictly not refundable. TheLinkTrade.com reserves the right to refuse any advertising requests for any reason as stated in "Right to Refuse".

Applicable laws

This Agreement shall be governed by the laws of the United States of America, except for its conflicts of laws principles. You irrevocably agree that the courts of United States of America shall have exclusive jurisdiction to resolve any dispute or claim of whatever nature arising out of or relating to this policy and consent or otherwise to the use of your personal data, and that the laws of the United States of America shall govern such dispute or claim. However, we retain the right to bring legal proceedings in any jurisdiction where we believe that infringement of our intellectual property rights or breach of those terms is taking place or originating. You are responsible for compliance with any applicable laws and regulations of the jurisdiction from which you are accessing this website.
